Acceptable Use Policy

This policy defines prohibited activities and usage restrictions to keep Clapwork safe and trustworthy for everyone.

1. Purpose

This Acceptable Use Policy ("AUP") applies to all users of the Clapwork platform, including freelancers, clients, organizations, and any other account holders. It supplements the Terms of Service and Master SaaS Agreement.

2. Prohibited Activities

You may not use the Clapwork platform to:

  • Fraud and Misrepresentation: Create fake profiles, submit false credentials, misrepresent qualifications, or impersonate another person or organization.
  • Spam and Unsolicited Communications: Send bulk unsolicited messages, harvest email addresses, or use the platform for any form of spam.
  • Assessment Integrity Violations: Use external tools, AI assistants, or unauthorized resources during proctored assessments. Share assessment questions or answers outside the platform.
  • Discrimination: Use assessments, interview tools, or hiring decisions to discriminate on the basis of protected characteristics including race, gender, age, religion, disability, sexual orientation, or national origin.
  • Illegal Activities: Engage in any activity that violates applicable local, national, or international laws.
  • Intellectual Property Infringement: Upload, share, or use content that infringes on others' intellectual property rights.
  • Platform Abuse: Attempt to gain unauthorized access, interfere with platform operations, or exploit vulnerabilities.
  • Data Harvesting: Scrape, crawl, or systematically extract data from the platform without authorization.
  • Circumventing Controls: Bypass rate limits, security controls, or access restrictions through technical means.
  • Competitive Misuse: Use the platform primarily to reverse-engineer, benchmark, or copy Clapwork features for a competing service.

3. API and Webhook Usage

Developers using the Clapwork API must:

  • Respect rate limits and not attempt to circumvent throttling mechanisms.
  • Store API keys securely and not share them in public repositories or client-side code.
  • Handle candidate data received via webhooks in compliance with applicable privacy laws.
  • Not use the API to create automated systems that discriminate against protected groups.

4. Content Standards

All content uploaded to or created on the platform must not:

  • Contain malware, viruses, or other harmful code.
  • Include explicit, abusive, threatening, or harassing material.
  • Contain personally identifiable information of third parties without their consent.
  • Violate any applicable laws or regulations.

5. Enforcement

Clapwork may investigate suspected violations of this AUP and take action including:

  • Issuing a warning with a specified remediation period.
  • Temporarily suspending account access pending investigation.
  • Permanently terminating accounts for serious or repeated violations.
  • Reporting illegal activities to law enforcement authorities.
  • Pursuing legal remedies for damages caused by AUP violations.

Clapwork reserves the right to modify this AUP at any time. Material changes will be communicated via email and posted on this page at least 30 days before taking effect.

6. Reporting Violations

If you believe a user is violating this Acceptable Use Policy, please report it through the platform's reporting tools or contact our Trust & Safety team directly.
